Tallahassee, FL – A death row inmate set for execution at the end of the month is appealing to the Florida Supreme Court yet again. Manuel Valle is the man who was convicted of killing a Coral Gables Police officer three decades ago. As Sascha Cordner reports, this is the third time the state has set an execution date for the 61-year-old.
State-appointed lawyers representing Manuel Valle are challenging a law that prohibits them from representing death row inmates in non-criminal proceedings.
They want to file a federal civil action challenging the state's denial of clemency proceedings in Valle's case. But, his lawyers can't because of the prohibition.
His attorneys say that is a violation of Valle's right to due process and equal protection rights.
Manuel Valle was originally scheduled to die on August 2nd when Governor Rick Scott first signed his death warrant. Then, when Valle appealed to the Florida Supreme Court to look into whether or not a lethal injection drug would cause him pain, the Court issued a stay of execution, until it was lifted. He later received another stay of execution, but that's been lifted as well.
Valle's appeal was filed Thursday.
