Water districts steamed over legislative power grab

Tallahassee, FL – Environmental groups are urging Governor Rick Scott to veto a bill that would increase the Legislature's authority over water management districts. James Call reports, they say the measure raises constitutional questions.

Senate Bill 2142, among other things, reduces water management districts budgets by 210 million dollars and gives the legislature the power to cap the amount of money districts raise through property taxes. Spokespeople for Audubon of Florida and The Everglades Foundation call it a power grab. One so bold that the Audubon's Eric Draper said could lead to a court case challenging districts authority to levy a tax.

There is some concern by subjecting them directly to control of the legislature they are viewed no longer as constitutional agencies that constitutionality itself of being able to levy property taxes could be challenged in court.

Lawmakers argued the Legislature's responsibility for the state budget entitles it to more oversight of the water management districts.
