The court stayed a scheduled May 13 execution to decide whether new evidence should be considered.

Tallahassee – The Florida Supreme Court is considering an appeal from a convicted killer who is under an active death warrant. James Call reports John Marek is sentenced to die for the kidnapping, rape and murder of a Barry University Secretary. His attorney says new evidence, statements by the co defendant and others should be considered.
